2. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

3. Using our website

You must be at least 18 years old to place an order. You agree to give accurate information when you place an order or create an account. You must not use our website for any unlawful purpose, to interfere with its operation, or to access data that is not meant for you.

4. Products

We take care to describe and photograph our products accurately. Colours can look slightly different depending on your screen settings. Please check the size guide on each product page before ordering. If an item does not match its description, you are covered by our Returns, Exchanges & Refunds Policy.

5. Prices

All prices are in Australian dollars (AUD). The total shown at checkout is the full amount you pay, with free shipping and no customs duties or import fees on delivery. Prices may change at any time, but a change will not affect an order you have already placed.

If a product is listed at an obviously incorrect price because of an error, we will contact you before dispatch. You can then choose to pay the correct price or cancel the order for a full refund.

6. Orders

After you place an order, we will email you an order confirmation. A contract for the sale of goods is formed when we dispatch your order.

We may cancel an order before dispatch if an item is out of stock, if there is a pricing error, or if we cannot verify the payment. If we cancel your order, we will refund the full amount to your original payment method.

You can ask to change or cancel an order by emailing us. We can do this as long as the order has not been dispatched.

7. Payment

We accept the payment methods listed on our Payment Methods page. Payment is taken when you place your order.

8. Shipping and delivery

Shipping times, delivery areas and tracking are explained in our Shipping Policy. Ownership and risk in the goods pass to you on delivery.

9. Returns, exchanges and refunds

10. Discount codes and promotions

Discount codes cannot be exchanged for cash and only one code can be used per order, unless the promotion says otherwise. Each promotion may have its own terms, which will be shown with the offer.

11. Store credit

Store credit issued by MELBAROSE is valid for 3 years from the date it is issued. It can be used on our website only and cannot be exchanged for cash, unless the law requires otherwise.

12. Email and SMS marketing

We only send marketing emails and SMS messages if you have agreed to receive them. Every marketing email includes an unsubscribe link, and you can opt out of SMS by replying STOP. Opting out does not affect order and delivery messages.

13. Intellectual property

All content on our website, including text, images, logos and designs, belongs to MELBAROSE or is used with permission. You may not copy, reproduce or use it for commercial purposes without our written consent.

14. Third-party services

Our website uses third-party services such as Shopify, Shopify Payments and our order tracking provider. Your use of these services may also be subject to their own terms. We are not responsible for the content of third-party websites linked from our website.

15. Limitation of liability

To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of our website. This clause does not exclude, restrict or modify any consumer guarantee or right you have under the Australian Consumer Law.

We collect and use your personal information as explained in our Privacy Policy.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute may be heard in the courts of New South Wales or any court that has jurisdiction under Australian law.
